As a follow up to our Excess Soil Guidelines post in March, The Ministry of the Environment, Conservation and Parks (MECP) has decided to move forward with a temporary suspension of the need to comply with the requirements under O. Reg. 406/19: On-Site and Excess Soil Regulation (“Excess Soil Regulation”) that came into effect on January 1, 2022, until January 1, 2023. The remainder of the year reverts back to the rules applicable in 2021.
One important note is that the grandfathering of contracts is not extended with the regulatory pause, so contracts entered in 2022 that carry into 2023 will need to meet the full regulatory requirements.
