Performance Audits

A Performance Audit (PA) is a comprehensive review of a newly constructed building to identify construction defects and support warranty claims. It includes a review of the construction drawings and documents, a unit owner survey, a visual walkthrough, and a deficiency list. Deficiency claims are itemized, clearly located, and are referenced by applicable codes and standards. Photographs are included in most cases. Our goal is to make it as easy as possible for the construction team to address.

While Performance Audits are required for condominium corporations, we have also completed Pre-Performance Audits to provide builders and developers a “head start” on addressing deficiencies. Savvy construction teams know that addressing deficiencies long after construction is complete is much more difficult and costly to manage. A proactive approach results in faster resolution, fewer complaints, and satisfied customers.

In Ontario, warranty coverage requirements are governed by the Condominium Act and its regulations. The PA process is managed by Tarion and is described in detail in Registrar Bulletin 2 (RB2).

The Corporation has one-year warranty coverage that includes:

  • Defects in workmanship and materials
  • Defects that cause the building to be unfit for habitation
  • Ontario Building Code violations
  • Major structural defects
  • Unauthorized substitutions

The Corporation has two-year common element warranty coverage that relates to water penetration through the basement/foundation walls and building envelope, defects in the electrical, plumbing, and mechanical delivery and distribution systems, and violations of the Ontario Building Code affecting health and safety.

The seven-year warranty covers Major Structural Defects (MSD), which is a defect of a structural load-bearing element of the building that results in failure, that affects the usual and ordinary service life of the element, or affects the use of a significant portion of the building for usual and ordinary purposes.
